HIPAA

1. How does HNA ensure the privacy for its clients?

All client information obtained by HNA is kept within the company and used only for the purpose of providing quality client care. This information is provided only to the assigned caregivers and office employees on a need to know basis. All employees that are privy to client information will not share that information with anyone outside the company or with anyone in the company that does not have a need to know.

2. Who within HNA has authorized access to client and employee records as well as company data, and what criteria are used to determine this access?

The Executive Director, President, Supervisor, Owners and Employees or contracted individuals directly involved in the case.

3. Under what circumstances does HNA disclose information to third parties without the written consent of the client or employee?

• If it is required by law.
• Staff or contracted individuals require the information in order to provide services to a client.
• The client or employee has authorized certain individuals or organizations to be giver the information.
• Certain representatives have been authorized to investigate the Agency.

4. Is client or employee approval required before releasing information to third parties?

Yes, written consent to release information to Third Parties shall be obtained by having the client or employee sign the Consent to Release Information form

5. What measures does HNA implement to ensure the safety and confidentiality of client personal information?

• Individually identifiable, personal information shall be handled in the same confidential manner whether it is in written, electronic, or verbal form.
• All active and inactive client records shall be stored in a secure location.
• Personal information shall not be left on a client’s voicemail, unless the client was given permission to do so. If permission is not given, a message shall be left for the client to return the call.
• Confidential client information shall be destroyed through shredding.

6. What steps does HNA outline to address suspected or actual breaches in client or employee confidentiality?

• The details shall be fully documented.
• The incident shall be investigated by the Administrator/Manager/Supervisor or depending on the situation, a Certified Investigator.
• The employee involved shall be questioned.
• If there is just cause, the employee involved shall be justified to disciplinary action.

7. What specific HIPAA guidelines are emphasized as essential for employees to understand and uphold while working at HNA?

• Only HNA employees are permitted to see the Client’s information and plan of care.
• No one other than an HNA employee is allowed to see your client schedule.
• No names of clients may be used at another client’s home.
• You may NOT discuss personal or private matters of a client with anyone other than an HNA Office Staff member, the Executive Director, or Owner.
• You may NOT show a Client or a Client’s family the Client Care information provided to you by HNA. This information was provided to you to help you provide the best care possible and some information may be upsetting to the client or their family.
• All client information should be kept out of view and in a secure place when away from work as well (this includes timesheets).
• No photographs, video recordings, or other similar methods of documentation of a Client, their home, or their information is permissible.

8. Are all employees trained in HIPAA policies?

Yes, all employees have undergone training and are fully aware and qualified in HIPAA policies.
